Terms of Service and sales
I. GENERAL CONDITIONS OF USE
1. Scope
These general conditions of use (hereinafter the “T&Cs”) apply to any visit or use of the Platform and its information by an Internet user (hereinafter “User”).
By visiting or using the Platform, the User acknowledges having read these T&Cs and expressly accepts the rights and obligations mentioned therein.

The User's personal data is processed in accordance with the Privacy Charter available on the Platform.
6. General provisions
FIBR.STUDIO reserves the right to modify, extend, delete, limit or interrupt the Platform and associated services at any time, without prior notification, and without incurring liability.
In the event of violation of the T&Cs by the User, FIBR.STUDIO reserves the right to take appropriate sanction and repair measures. FIBR.STUDIO reserves the right to refuse the User any access to the Platform or our services temporarily or permanently. These measures may be taken without giving reasons and without notice. These General Conditions of Sale may be modified at any time by FIBR.STUDIO. 2. Offer of Products and Services
The Products and services offered for sale are those available at the time of confirmation and payment of the order by the Customer.
FIBR.STUDIO reserves the right to modify its offer at any time, in particular by adding, modifying or deleting Products.
The Products are presented as accurately as possible. The perfect representation of the Products on the Website cannot be guaranteed, in particular due to differences in color or material rendering by Internet browser software and/or display monitors. 3. Price
The prices of the Products are indicated in Euros and are inclusive of all taxes. Delivery costs are not included in the price indicated, unless otherwise stated. FIBR.STUDIO reserves the right to modify the price of the Products at its convenience. The pricing conditions in force on the date of validation of the order by the Customer will apply.
The total amount of the order (all taxes included) and, where applicable, the addition of delivery costs is indicated before final validation of the order form.

Custom creation and services include quote pricing. The signed quote or order form constitutes agreement regarding the requested prices.

4. Order online
4.1 Placing the order

Any order placed on the Site www.fibr-studio.com requires the creation of a customer account. The Customer must provide a valid email address, billing details and, where applicable, a delivery address. Any exchange with the Seller may take place using this email address. In addition, the Customer must choose the delivery method and validate the payment method.
The Customer must add the selected products to their basket. The Customer has the possibility to check the details of his order, its total price and can make modifications before any final validation. Orders sent to FIBR.STUDIO by mail or fax will not be taken into account.
4.2 Validation of the order
Acceptance of the order by the Customer is materialized by his acceptance of these General Conditions of Sale, the description of the products or services and his payment.
FIBR.STUDIO reserves the right to refuse an order for any legitimate reason, in particular the existence of an unresolved dispute resulting from non-payment of a previous order, incorrect address or any other problem on the Customer's account. and this until the problem is resolved.
FIBR.STUDIO will send by email, as soon as possible, an order confirmation including the substantial elements (order number, products ordered, place of delivery, etc.). The Customer agrees that the order confirmation will be considered as proof of the contractual relations born with FIBR.STUDIO.

5. Payment
The Seller remains the owner of the items ordered until full payment for the order has been received.
5.1 Payment
Payment is made in euros exclusively, in full upon ordering, either by credit card, bank transfer, PayPal, gift card, credit note or voucher. As orders are only taken into account after validation of their payment, no discount or late payment penalty is applicable. Payments cannot be suspended or subject to compensation without prior written agreement from FIBR.STUDIO.
For custom creations, a 50% deposit will be requested upon ordering, followed by payment of the balance before delivery of the goods.
5.1.1 Payment by bank card
The following bank cards are accepted: Carte Bleue, Visa, Mastercard and Bancontact. FIBR.STUDIO may be required to verify the bank details and/or identity of customers before any delivery. By placing their order on the Site www.fibr-studio.com, the customer undertakes to provide FIBR.STUDIO with the requested supporting documents. If the requested elements are not communicated within the allotted time, FIBR.STUDIO reserves the right to cancel the order subject to verification.
5.1.2 Payment by bank transfer
All payment by bank transfer is made in full upon ordering, with the exception of the payment of a deposit during the custom creation. The FIBR.STUDIO RIB will be communicated to the customer on the order confirmation page as well as by email, or present in the legal notices.
In the event of failure to receive the bank transfer within three (3) working days from confirmation of the order by the Customer, the order will be considered canceled.
5.1.3 Payment by PayPal
When validating their order, the Customer must enter their PayPal email address as well as their PayPal password. 5.1.4 Payment by gift card

6. Proof

7. Delivery
Delivery is only made after confirmation of payment by the Seller's banking organization.
The products are delivered to the address indicated by the Customer on the online form serving as an order form.
7.1 Delivery costs and terms
Delivery can be made to the workshop, delivered to your address (under certain mileage conditions predefined on the website www.fibr-studio.com), or to the Customer's home within a 50km radius of the workshop. The type of transport, the time and the related costs will be specified when ordering, depending on the place of delivery, the nature of the Products ordered and the nature of the service for which the Customer has opted. Any order including a custom-made product cannot be split and will necessarily be delivered in its entirety by carrier to the delivery address specified by the Customer. Additional costs arising from incomplete or incorrect information by the Customer will be invoiced to the Customer.

Any withdrawal of goods is subject to presentation of the order form and a valid identity document in the name of the person appearing on the order form. Delivery by carrier: Delivery of items is ensured by a carrier. The delivery date and time slot are set jointly by the carrier. It is up to the Customer to check the delivery terms when validating the order.
The impossibility for FIBR.STUDIO's carriers to deliver the Products on the agreed date, in the event of the Customer's absence or lack of information on the need to use specific means of delivery, may give rise to the payment of additional delivery costs and/or cancellation of the order by FIBR.STUDIO.
The risks of the Product are transferred to the Customer upon delivery by the carriers on the delivery date agreed with them.
Delivery takes place, according to the method chosen by the Customer, within the following deadlines:
The products are delivered to the delivery address that was indicated when ordering and within the deadlines indicated (6-10 days).

Additional time may be considered when we are in the case of co-creation (the time frame depends on the creation time and the availability of everyone to work on the project. This is discussed at the initiative of the project) or a pre-order.
Delivery times are indicative. No compensation can be claimed from the Seller or the carrier in the event of late delivery. If delivery times exceed thirty days from the order, the sales contract may however be terminated and the Customer reimbursed.
Delivery costs are FREE for packages not exceeding 30kg and with a total surface area of 300cm (max 150cm length) for Belgium, Luxembourg, France, Germany and the Netherlands. Apart from these conditions, FIBR.STUDIO reserves the right to adapt the delivery costs and to invoice them when placing the order on www.fibr-studio.com on www.fibr-studio.com or by another means (non-exhaustive list).
7.2 Reception and complaints
Usage reservations: The Customer (or his agent) is required to check the physical condition of the packaging, the number and content of the packages at the time of delivery, in the presence of the delivery person or the store team. Any anomaly concerning delivery (transport damage, missing product or package, broken product, product not in conformity with the order, etc.) must, under penalty of inadmissibility of the request, be indicated on the carrier's delivery slip in the form detailed, explicit, motivated and dated handwritten reservations. Any complaint received after the deadline will be definitively rejected without possibility of recourse for the Customer.
Product defects: In the event of an apparent defect or non-compliance of the product delivered with the characteristics of the Product ordered as appearing on the order form, the Customer (or his agent) must report these defects within three (3) days following the delivery date by sending FIBR.STUDIO a registered letter with acknowledgment of receipt. The Customer (or his agent) must refrain from any intervention on the product and must allow FIBR.STUDIO every opportunity to identify the defects or anomalies cited. Otherwise, the complaint cannot be admitted. Any complaint made after this deadline will be rejected without possibility of recourse for the Customer. The products are described with the greatest possible accuracy. In the event of a defect or non-conformity of the product duly noted by FIBR.STUDIO and rendering the product unfit for the use for which it is usually intended, the provisions provided for in terms of Guarantee will apply.
If the package you receive is damaged by the carrier, refuse it or return it to the post office, accompanied by a complaint to the carrier before opening it. A package that you have opened is no longer insurable by FIBR.STUDIO and is no longer insurable by the carrier. It will therefore no longer be subject to compensation or reimbursement.
Whatever the nature of the complaint (product defect or delivery problems), the Customer (or his agent) cannot refuse delivery to the carrier, the Customer (or his agent) must keep the product(s). s) until acceptance of the return by FIBR.STUDIO.

8. Return/Right of withdrawal
The Customer has a right of withdrawal of fourteen (14) calendar days from the day of receipt of the Products. Products made to measure or specially ordered cannot be returned, exchanged or refunded. The products or services are artisanal creations, unique products created using artisanal materials. Variations and small imperfections may therefore appear.
Any complaint and any return not made in accordance with the rules defined above and within the time limits cannot be taken into account and will release the Seller from any liability towards the Customer.

9. Guarantees
Products sold by FIBR.STUDIO are guaranteed for two (2) years from their delivery or collection. FIBR.STUDIO is therefore responsible for any lack of conformity of said Products.
The lack of conformity must be reported to the Seller as soon as possible and, in any event, no later than two months after its discovery.

To be admissible, the implementation of the guarantee involves the submission, by the Customer, of the Product as well as the purchase invoice. FIBR.STUDIO undertakes to repair or replace the Product recognized as defective by its services according to the Customer's choice. If repair or replacement is impossible or generates disproportionate costs, FIBR.STUDIO may reimburse the Product. Repaired or exchanged Products benefit from the warranty for the remaining period. 11. INTELLECTUAL PROPERTY

12.LIMITATION OF LIABILITY
12.1 Use of the Website

12.2 Force majeure
The occurrence of an event constituting force majeure will result in the suspension of obligations weighing on FIBR.STUDIO. 13.2 Partial non-validity
If one or more stipulations of these General Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their strength and reach.
13.3 Non-waiver
The fact that one of the Parties has not required the application of any clause of these General Conditions of Sale, whether permanently or temporarily, can in no case be considered as a waiver of the rights of this Part arising from the said clause.

14. DISPUTES
These General Conditions of Sale are subject to Belgian law. Any dispute relating to the execution hereof will be under the exclusive jurisdiction of the Belgian courts.

III. General Conditions of Sale - Professional Customers

1. THE PRODUCTS
The products offered for sale by FIBR.STUDIO (hereinafter the “Products”) are presented in accordance with legal requirements and as accurately as possible. Differences between the Products delivered and those represented on the site www.fibr-studio.com (hereinafter the “Site”) or the catalogs may exist, mainly for artisanal Products for which the homogeneity of production cannot be perfectly insured or for those having been the subject of adaptations linked to technical or technological developments. Also, any Professional ordering from FIBR.STUDIO for use in an ERP must first ensure the conformity of the Products for such use. FIBR.STUDIO cannot be held responsible in the event of non-compliance with these requirements.
In addition, some of our Products are not suitable for intensive use and are therefore not recommended for Professionals. Professionals must, prior to any order, ensure that the Products selected are suitable for the use for which they intend them.

2. PRICES
2.1. Products :
Our prices are displayed in euros or in local currency depending on the country of destination of the offer, all duties and taxes included, excluding any customs clearance costs. Delivery costs are not included in the prices displayed, unless otherwise stated.
Our prices are subject to change, particularly when a new catalog is released. The prices displayed at the time of placing the order will apply.
2.2 Delivery:
Standard delivery rates are available on the website, in the FIBR.STUDIO Customer Terms and Conditions, on www.fibr-studio.com.
Specific delivery rates are provided by FIBR.STUDIO, on a case-by-case basis.

3. THE ORDER
The order placed and validated on the website www.fibr-studio.com, in the workshop or by email (without this list being exhaustive) is firm and final upon full payment or upon payment of the first deposit of 50% for a tailor-made order by the Customer and its confirmation by FIBR.STUDIO.
The order placed and validated with FIBR.STUDIO is firm and final upon signature of the quote by the Customer and its confirmation by FIBR.STUDIO.
The Products remain the property of FIBR.STUDIO until their full payment. Delivery times start from payment for the goods or according to the production times specified in the quote. In his capacity as a Professional, the Professional Customer does not benefit from any right of withdrawal and cannot claim the provisions of consumer law whatever the method of placing the order (order placed on the website www.fibr-studio .com, at the workshop, by email or by telephone, without this list being exhaustive).
A minimum order amount may be imposed depending on the delivery method.

4. BILLING AND PAYMENT

The invoice is issued after acceptance of the order by FIBR.STUDIO.
For tailor-made creations, the amount of the order is payable in two stages: a deposit of 50% of the total amount upon validation of the order and the balance before delivery of the product, by credit card or bank transfer. Any exchange costs are entirely the responsibility of the Customer.

The Customer has the obligation to verify the various information recorded when placing his order and in particular his billing address. In the event of a customer error, the invoice cannot, under any circumstances, be modified.
Payments by credit card on our website are secure in accordance with Belgian and international interbank regulations. This solution allows the Customer to make their purchases in complete security. The bank details of the Customer paying by credit card are not kept by FIBR.STUDIO.
FIBR.STUDIO may be required to verify the bank details and/or identity of Customers before any delivery. By placing their order on the FIBR.STUDIO website, the Customer undertakes to provide FIBR.STUDIO with the requested supporting documents. In the absence of communication of the elements requested by FIBR.STUDIO within the allotted time, the latter reserves the right to cancel the order subject to verification.
Any late payment gives rise to the payment of a penalty equal to 3 times the legal interest rate in force in Belgium in addition to the lump sum of 40 euros intended to cover recovery costs. The existence of an unpaid amount by a Customer authorizes FIBR.STUDIO to refuse any new orders from this Customer.

5. DELIVERY
The delivery terms are specified when the order is validated by FIBR.STUDIO, specifying the general T&Cs.
The order will be delivered by parcel according to the deadline communicated by the carrier. This deadline is, however, indicative.
Delivery by specialized carrier: Delivery of the order can be made by a specialized carrier if this proves necessary to guarantee the proper delivery of the product in its current state. The Customer is required to ensure, prior to any order, that the products can be transported via normal routes of access to the place of delivery, particularly in terms of size and volume. Any basket or freight elevator costs are the responsibility of the Customer.
The impossibility for FIBR.STUDIO's carriers to deliver the Products on the agreed date, in the event of the Customer's absence or lack of information on the need to use specific means of delivery, may give rise to the payment of additional delivery costs, storage costs, warehousing costs and cancellation of the order by FIBR.STUDIO.
The risks of the Products are transferred to the Customer upon delivery into their hands, or into those of any third party mandated by them, in particular freight forwarders.

6. RECEIPT AND COMPLAINTS
The Customer must carry out, upon delivery, all necessary examinations to detect any damage, missing items, defects or other apparent defects or non-conformity of the Products delivered to his order. The Customer must in particular check the condition of the packaging, the number of packages and the Products in their quantities, their references, their condition and their characteristics. The Customer has 72 hours from receipt of the goods to express reservations and transmit them to FIBR.STUDIO.
Under penalty of inadmissibility of his request, the Customer must:
- Include on the delivery note precise and reasoned reservations in the event of damage or missing items, general reservations such as “subject to unpacking” being insufficient;
- Confirm your reservations, within the aforementioned period, for missing or damaged items and express your other reservations to FIBR.STUDIO: contact@fibr-studio.com for any order placed with FIBR.STUDIO.
The Client must also be able to provide any justification as to the reality of the complaints invoked and allow FIBR.STUDIO, its carriers or any person mandated by them, every facility to establish them, the Client having to refrain from intervening or involving a third party for this purpose.
In the event of non-compliance of one or more products, after validation by FIBR.STUDIO, the returned Product must be returned to FIBR.STUDIO carriers in perfect condition, in its original packaging and equipped with all its accessories. No spontaneous returns, without agreement from FIBR.STUDIO, will be accepted.

7. PRODUCT WARRANTY
7.1. Scope of warranty
The Products are guaranteed for a period of two (2) years from their delivery against all manufacturing, design or material defects. During the warranty period, FIBR.STUDIO undertakes to offer, at its discretion, a replacement or recovery solution for Products recognized as defective by its services. Exchanged Products benefit from the guarantee for the remaining period.
Excluded from the warranty:
– damage to the Product resulting from normal wear and tear having regard to its nature, function, composition and price;
– slight differences noted on the Products as defined in article 1;
– all defects in the Product which may result from poor installation, storage, conservation, or assembly (non-compliance with assembly instructions), lack of maintenance, misuse or 'use not in accordance with the technical or usage specifications (non-compliance with maintenance and upkeep requirements), modifications or repairs carried out by the Customer or a third party, damage caused by external objects (television excessive weight on furniture not designed for this use), external events such as accidents, shocks, fires, acts of vandalism, water damage, natural or artificial lights (in the event of discoloration), natural disasters or bad weather ;
–   Products not recommended for Professional use.
7.2. Implementation of the guarantee
To implement the guarantee, the Customer will contact FIBR.STUDIO: contact@fibr-studio.com for any order placed on the site www.fibr-studio.com, and will send photographs of the defective products specifying the conditions of use of said Products. Presentation of the original invoice will be required to benefit from the guarantee.

8. RESPONSIBILITY
FIBR.STUDIO's liability for the Products delivered, including within the framework of the applicable contractual and/or legal guarantees, is limited to the price of the defective or non-compliant Products. FIBR.STUDIO cannot be held responsible for compensation for indirect damage or any other financial loss suffered by the Client or a third party.

9. PERSONAL DATA
FIBR.STUDIO attaches great importance to the protection and respect of the privacy of its Customers and their personal data and undertakes to comply with applicable regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. FIBR.STUDIO collects and processes the personal data of its Customers in order to manage the different stages of the order, answer questions and carry out satisfaction surveys following an order. The Customer has a right of access, rectification, opposition and deletion of personal data concerning him. He can also request the limitation and portability of his data. The Customer can exercise his rights by writing to the address contact@fibr-studio.com, specifying his contact details (surname, first name, email address, telephone number). FIBR.STUDIO may be required to verify the identity of the Customer in order to secure the processing of their request.

10.2. Evidence
By express agreement between FIBR.STUDIO and the Customer, emails will be authentic between the Parties as will the automatic recording systems used on the Site, in particular as to the nature and date of the order.
The Customer can access, in accordance with the rules of common law, the electronic contract or “paper version” concluded with FIBR.STUDIO. To do this, he must contact FIBR.STUDIO by email (contact@fibr-studio.com) to whom he will provide all the necessary information, in particular the order number and his contact details.
10.3. Partial invalidity
If one or more stipulations of these General Terms and Conditions are held to be invalid or declared such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and effect. their scope.
10.4. Non-waiver
The fact that one of the Parties has not required the application of any clause of these General Terms and Conditions, whether permanently or temporarily, cannot under any circumstances be considered as a waiver of the rights of this Party arising from of said clause.
10.5. Modification of the T&Cs
FIBR.STUDIO reserves the right to modify these General Terms and Conditions at any time. The General Terms and Conditions applicable to any order are those in force on the day of the order.
10.6. Entire contract
These General Terms and Conditions and the order summary sent to the Customer form a contractual whole and constitute the entirety of the contractual relations between the Parties.
10.7. Resale of products.
The resale of FIBR.STUDIO products covered herein is strictly prohibited, without written agreement.

11. APPLICABLE LAW / JURISDICTION
Relations between Professional Clients and FIBR.STUDIO are governed by Belgian law. The PARTIES elect domicile at the address of their respective head office.
In the event of a dispute which cannot be resolved amicably, any legal action will be brought before the competent courts of the place of the defendant's registered office.
